Acceptance of Terms

By accessing, browsing, or using this website or any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must immediately cease use of our services. Nothing in these Terms limits any statutory right you have as a consumer that cannot lawfully be waived by contract.

USE AT YOUR OWN RISK: Vertigo provides software for educational and research purposes only. We make no representation or warranty, express or implied, that our software is or will remain undetectable by any third party. By using our services, you acknowledge and accept that:

  1. Use of third-party software of this kind may breach the Terms of Service of third-party games or platforms, and enforcement of those terms is entirely outside our control.
  2. Except where liability cannot lawfully be excluded (for example, in cases of our own fraud, willful misconduct, or gross negligence), Vertigo is not liable for account suspensions, bans (manual or automatic), or Hardware ID (HWID) bans resulting from your use of the software.
  3. We do not provide compensation or refunds for losses (financial or digital) arising from actions taken by third parties, including platform operators.

License Grant and Restrictions

Subject to your compliance with these Terms and payment of applicable fees, Vertigo grants you a limited, non-exclusive, non-transferable, revocable license to use the software for personal use only.

  • Single PC: Each license key is valid for use on a single PC at a time, tied to that device's Hardware ID.
  • Key Sharing: Sharing, sub-licensing, reselling, or otherwise making your license key available to another person is prohibited.
  • Prohibited Conduct: Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the software, except where such restriction is prohibited by applicable law, constitutes a material breach of these Terms.

ENFORCEMENT: Where we reasonably determine that a license key has been shared, leaked, or redistributed in breach of these Terms, we may suspend or deactivate that key. Before permanent deactivation for a first-time, non-fraudulent breach, we will make reasonable efforts to notify you and give you an opportunity to respond. Deactivation for confirmed breach does not entitle you to a refund.

System Compatibility & Maintenance

  • It is your responsibility to confirm your hardware and OS meet our published requirements (Windows 10/11 up to 24H2, AMD/Intel) before purchase. Where required by applicable consumer law, we will provide this information clearly prior to purchase.
  • We may modify, suspend, or discontinue any part of the service for maintenance, updates, or legal/compliance reasons. Where downtime is planned and extends materially beyond a reasonable period, we will make reasonable efforts to notify affected users; this clause does not override any statutory remedy available to you.

Limitation of Liability & Indemnification

To the extent permitted by applicable law, Vertigo's total liability arising out of or relating to these Terms or your use of the service is limited to the amount you paid for the license giving rise to the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. You agree to indemnify Vertigo against third-party claims arising from your breach of these Terms or your misuse of the software, except to the extent such claims arise from our own breach, negligence, or willful misconduct.

Governing Law

These Terms are governed by the laws of Sweden. If you are a consumer, this choice of law does not deprive you of the protection of any mandatory provisions of the law of the country in which you are habitually resident. Any dispute not resolved through our support channels may be brought before the competent courts, subject to any mandatory consumer venue rules applicable to you.

2. Refund Policy

Right of Withdrawal & EU Digital Content Waiver

If you are an EU consumer, you have a 14-day right of withdrawal under the Consumer Rights Directive 2011/83/EU for an unactivated license key. For digital content delivered immediately, this right can only be waived if you have given prior, explicit consent to immediate performance and acknowledged that you thereby lose your right of withdrawal — consistent with Article 16(m) of the Directive.

WAIVER: At checkout, activating a license key or downloading the software requires your explicit, separate confirmation that (a) you consent to immediate delivery of digital content, and (b) you understand this waives your statutory 14-day withdrawal right for that key. Without this confirmation, delivery will not proceed.

Refund Conditions

  • Incompatibility: If the software does not function due to your system not meeting our published requirements, this is not treated as a defect for refund purposes, provided the requirements were disclosed prior to purchase.
  • Bans: We do not offer refunds solely because a game account or device was banned by a third party, as this is a foreseeable and disclosed risk of use rather than a fault in the software itself.
  • Defective Product: Where the software itself is faulty (e.g., fails to activate or function as described through no fault of your system or conduct), you retain your statutory right to a repair, replacement, or refund under applicable consumer law, regardless of the above.
  • Cryptocurrency Payments: Given the irreversible nature of crypto transactions, refunds for crypto payments are issued as store credit or a manual reversal at our discretion, except where a refund is legally required (see Defective Product above).

3. License Usage

One PC Per Key & Deactivation

Each license key is tied to a single machine's HWID at any given time.

If our system detects that a key is being used across multiple devices without an approved transfer, we may suspend the key while we investigate, and may permanently deactivate it if unauthorized sharing is confirmed.

HWID Resets & Transfers

  • Keys may be transferred to a new PC by opening a support ticket in our Discord server.
  • HWID resets are granted at our reasonable discretion, generally limited to legitimate hardware changes. Repeated or clearly abusive reset requests may result in restrictions on future resets or, in serious cases, license termination.
